Terms and conditions All purchases are subject to these Terms & Conditions. All buyers agree that these conditions are binding upon them. You are strongly advised to read these Terms and Conditions before buying. These terms and conditions form part of the contract of sale between the Seller (B.G. Motors) and the Buyer or Purchaser. The Buyer accepts these terms and conditions as part of the contract of sale notwithstanding the fact that the Buyer may not have read these terms and conditions.   These terms and conditions apply to the purchase of any salvaged vehicles or components advertised for sale in any medium and on any device on behalf of B.G. Motors.   Vehicle Categorisation Terminology. B.G. Motors use standard terminology for the categorisation of salvaged vehicle conditions. Terms such as ‘Light damage’, Medium, front damage’, ‘Heavy, rear damage’, ‘Salvage only’, etc. are used as typical salvage categorisation terminology and do not represent a complete and accurate description of the vehicle in question. Any vehicle may have been reported to MIAFTR and as such may show up on any vehicle checks. B.G. Motors cannot guarantee that vehicles sold as NROV (Not Recorded On V-Car) at the time of sale will not be recorded on the HPI register or any other ‘alert’ register at a later date.   Car Spare Parts Most vehicles and parts of vehicles sold by B G Motors are auto-salvage and are sold as such. Whilst we make every effort to give good value to our customers, we cannot guarantee each part to be absolutely perfect and this is reflected in the price when compared to the price of a new item or part. B G Motors will always try to supply the exact part our customer requires. Due to the variations in make, model, design and year of manufacture, we cannot give any guarantee that all parts are correct or fit for the purpose required. It will help if customers can bring a sample part for comparison, but all sales are made on the strict understanding that the customer is responsible for making sure that parts bought are correct or fit for the purpose required. In the event of a part purchased is not correct for the particular vehicle, B G Motors will attempt to replace the part with the correct one, provided that within 48 hours, the part is returned or notification is given of the customers intention to return the part.   Please note: B G Motors shall not be under any obligation to replace any parts returned to them under these circumstances or to give any refund in respect thereof. Any part which is found to be faulty or unserviceable (unless the fault was declared on purchase) will be repaired, exchanged or money refunded according to circumstances, provided that B G Motors are notified in writing within the period specified in the guarantee clause under which the goods were sold. Goods or parts sold from the establishment are guaranteed or warranted for the time specified in the following clauses:-   A) The article offered for sale has been removed from the donor vehicle, tested and inspected and found to be of such quality as to carry an unconditional guarantee of straight exchange of money back should a replacement unit not be available, if the article should be found to be faulty or unserviceable. (The minimum period of guarantee for this category is 28 days).   B) Because of the age and condition of the donor vehicle, testing or inspection of the article offered for sale has not been practicable. However, should the article be found to be unsatisfactory, a full refund will be given provided that the article is returned within a specified period. (The minimum period of guarantee for the category is 7 days)   C) The terms and conditions of the sale of the article or articles offered for sale under this category and the terms of any guarantee agreed are subject to negotiation between the buyer and seller at the time and point of sale. Although there is not minimum period of guarantee for this category, all terms and conditions of the guarantee must be clearly stated on the invoice or receipt relating to the sale and signed by both the buyer and seller at the time of sale.   B G Motors shall not be liable or responsible for:   A) Any fault or defect in parts arising from wilful damage, negligence, failure to follow their instructions (whether written or oral), misuse or alteration to parts carried out otherwise than by B G Motors.   B) Any fault or damage caused by the fitting of parts otherwise than by B G Motors.   C) Any consequential or indirect loss claimed under any circumstances.   Bearing in mind that all parts are auto-salvage and the price substantially less than new, B G Motors is not responsible for any costs incurred if any vehicle is off the road whilst parts are being brought back for exchange. These terms of business are not intended to restrict or exclude any legal rights hereto or implied by law. These Terms of Trading are primarily designed to apply to transactions entered into with customers. Where transactions are entered into with other businesses, certain provisions implied by law may be excluded, subject to tests of reasonableness, as prescribed by the Unfair Contract Terms Act, 1977.   Accuracy of Information Neither B.G. Motors nor any Internet access provider is responsible for incorrect or inaccurate entry of information, human error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, failures of any telephone network, computer equipment, software or any combination thereof, or inability to access B.G. Motors website. Neither B.G. Motors nor any Internet access provider is responsible for any other error or malfunction which might occur. If the purchaser relies on this service or any material available through this service, the purchaser does so at their own risk. The purchaser understands that there may be delays, omissions, interruptions, inaccuracies, and/or other problems with the information, products, and services provided at this site. B.G. Motors and its affiliates, agents, vehicle suppliers and licensors cannot do not warrant the accuracy, completeness, currentness, non-infringement, merchantability or fitness for a particular purpose of the information available through this service. Nor do they guarantee that the service will be error free, or continuously available, or that the service will be free from viruses or other harmful components. ANY INFORMATION IN ANY FORMAT ASSOCIATED WITH ANY VEHICLE, GIVEN BY B.G. MOTORS OR ANY OF ITS SUBSIDIARIES OR EMPLOYEES OR AGENTS, IS ONLY ACCURATE TO OUR KNOWLEDGE WITHOUT INVESTIGATION. ANY DESCRIPTION OF DAMAGE IS AS IDENTIFIED BY AN OUTSIDE PARTY, AND AS WITH ANY WRECKED/DAMAGED VEHICLE, THERE IS ALWAYS THE POTENTIAL FOR MISSED AND/OR HIDDEN DAMAGES. B.G. MOTORS AND/OR THE SELLER IS NOT RESPONSIBLE FOR ANY DAMAGES ASSOCIATED WITH ANY VEHICLE. DESCRIPTIONS OF THE VEHICLE DAMAGE ARE ONLY DESCRIPTIONS AND ESTIMATES, THEY ARE GENERAL INDICATIONS ONLY AND ARE EXTREMELY UNLIKELY TO BE A COMPLETE LIST. UNLESS SPECIFICALLY STATED OTHERWISE, WE OFFER THE VEHICLES IN THEIR CURRENT STATE AND LOCATION WITH ABSOLUTLY NO GUARANTEE WHATSOEVER AS TO THE CONDITION, ROADWORTHINESS, OR RECORDED MILEAGE. THE VEHICLES ARE OFFERED IN A DAMAGED OR INCOMPLETE CONDITION HAVING BEEN THE SUBJECT OF AN INSURANCE COMPANY TOTAL LOSS AND WE EXPRESSLY EXCLUDE ANY WARRANTY AS TO THE SUITABILITY, MERCHANTABILITY, OR FITNESS FOR ANY PURPOSE OF ANY VEHICLE PURCHASED. IT IS THE RESPONSIBILITY OF THE PURCHASER TO ENSURE THAT THE PURCHASED VEHICLE IS IN A ROADWORTHY CONDITION BEFORE THE VEHICLE IS USED OR RE-SOLD. ALL VEHICLES SOLD AS-IS, WHERE-IS. THERE IS NO WARRANTY EXPRESS OR IMPLIED INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF TITLE MERCHANTABILITY FOR A PARTICULAR PURPOSE OF ANY KIND ON ANY VEHICLE SOLD. MOST VEHICLES SOLD BY MOTORS HAVE BEEN DAMAGED IN AN ACCIDENT, THEFT RECOVERY, REPOSSESSION, ETC, UNLESS EXPRESSLY INDICATED IN WRITING.
